Introduction

    The Islamic Republic of Iran began to implement the first five year economic plan aimed at the reconstruction and economic recovery in 1989, after the end of the eight year Iraqi imposed war.  The main objective of this plan was to transform the managed economy of the war to an open economy based on market forces and establish and maintain relations with the world economy.

     Due to the existing limitation for the application of the market economy, concern for the side effects of such a sharp transformation on the social wellbeing of the society it was decided to assign some locations and establish free or special economic zones in order to completely apply the principle of a free market economy.  This way, enough attraction incentives could be introduced for absorbing foreign investment. 

    According to the legally accepted definition, the free trade zones and special economic zones are those parts of the Iranian territory that are managed according to the special laws and bylaws and are excluded from the laws of the governing motherland.  These zones are excluded from the domain of the custom authorities and enjoy the full freedom for the in and out flow of goods and commodities.  Unique geographical locations, sufficiently developed infrastructure and the foreign investment incentives have provided ample opportunity for internal as well as foreign investment in the zones.

    The Iranian Parliament approved the Free Zones Act in September of 1993.  According to this act, Kish Island, Qeshm Island and the Port of Chabahar were declared as the Free Zones of Iran.   The council of ministers later adapted the bylaws of the free zones.  These bylaws have defined and set out all regulations pertaining to  import, export, investment, insurance, banking, labour, and employment of these zones.

ADMINISTRATION

  • Iran's Free Zones are supervised by a council consisting of 14 ministers and high ranking officials under the chairmanship of the President of the Islamic Republic of Iran.
  • The Council has a Secretariat which coordinates the affairs of the zones. The Secretary of the Council is appointed by the President of the Islamic Republic of Iran.
  • Each Zone is administered by an Organization which is formed in accordance with the Iran's Commercial Code , having an independent juridical personality;
  • Those Organizations as well as their affiliated companies, are exempt from laws and regulations normally imposed on government owned companies;
  • The head of each Zone is the Chairman, and Managing Director of the Zone
  • Organization, appointed by the President of the Islamic Republic of Iran from the members of the Board of Directors and suggested by the members of the Council;
  • All governmental bodies and their local executives shall coordinate their activities in the Free Zones under the supervision of each Free Zone Authority.

 GEOGRAPHICAL ADVANTAGES

All three of Iran's Free Trade -Industrial Zones :

  • Are located at the southern coasts of the country and connected to the major international waterways via the Persian Gulf, the Oman Sea and the Indian Ocean;
  • Have easy access to major air, sea and land transportation routes at the local , regional, and international levels;
  • Are in proximity to regional markets with regard to import of raw materials, and intermediate or manufactured goods, and easy access to local and neighboring markets specially those of Western, Southern and Central Asia and the Persian Gulf;
  • Have reliable Public utilities and services;
  • Have availability to skilled and semi- skilled manpower with reasonable (competitive) wage demands in the region;
  • Have appropriate access to abundant sources of energy such as natural gas (2nd in the world) and crude oil (4th in the world);
  • Have wealth of mineral resources, unique in the Middle East, required for industrial production and exports;
  • Have international reputation as major trade centers;
  • Have appropriate climate and tourist attractions.

 

 INCENTIVES

Investment

  • Investment independently or in partnership with Iranian persons;
  • No restrictions on the percentage of the share holdings;
  • Free repatriation of net profits and capital;
  • Exemption from all kinds of taxes for the first 15 years;
  • The legal rights of foreign investors are guaranteed; in the event of nationalization, the Authority of each Zone shall make the compensation;
  • Foreign investors may lease land with reasonable rents, and own the buildings and other installations built on the land.

 

Imports & Exports

  • All goods imported into the Zones are exempt from customs duties and commercial benefit tax;
  • Exports of goods from the Zones to the mainland, to the extent of the added value plus the value of the used domestic raw materials, are exempt from customs duties and commercial benefit tax;
  • All goods, shipped to the Zones from the mainland, are deemed domestic transference.

 

No entry visa requirement

  • Foreign nationals who choose direct entry to the Zones, do not need to apply for visa in advance ;
  • For entry into adjacent zones, a double entry visa can be obtained from the Embassies or Consulates of the I.R.Iran in any country from which they wish to apply.

 

Banking Facilities

  • The offshore banking and non banking credit activities regulations in the Zones are flexible, and compatible with international offshore banking practices and standards;
  • Foreign banks and financial institutions may open head offices, branches,and counters independently or in partnership with domestic partners;
  • No foreign exchange control; the conversion of the Iranian Rial to any other currency is readily permitted;
  • Transfer of foreign currencies and Iranian Rials abroad is permitted.

 

Engagement of Manpower

  • All matters related to manpower employment are dealt with according to the contract and agreement initially concluded between the employer and the employee;
  • The labour regulations practiced in the Free Zones are unique and they are formulated in accordance with ILO recommendations;

Arbitration

  • Any probable disputes will be settled according to the relevant terms of contract originally concluded between the parties.

Kish

Free trade-Industrial Zone

Geographical Situation

Kish Island, the second largest in the Persian Gulf, has a total area of 91 sq. km. Its distance to the nearest port in the mainland is 18 km, 90 km. to Bandar Lengeh, 300 km to Bandar Abbas, and 200 km to the United Arab Emirates.

Major Characteristics

Known as the pearl of the Persian Gulf, the Island has a moderate climate for 8 months of the year. Breathtaking coastal scenery, a unique aquarium, recreational and water sports facilities are among a number of attractions which has made Kish a proper place for the expansion of tourism.

Accessible Markets

From the commercial aspect, mainland and the countries around the Persian Gulf are the sphere of influence of Kish economy, and from the touristic aspect, it goes as far as the Central Asian Republics.

Communications Network

Kish international airport manages daily flights which connect the Island with 12 major cities in Iran and more than 10 destinations abroad. The Kish harbour designed with a depth of 4 m, can accommodate 2000 ton vessels.

Utilities and Services

The production rate of the water desalination facility is over 8000 cubic m daily. 90 megawatts of electricity is also available. Soon the Kish telephone network will be connected to an advanced 5000 extensions network, with 1000 mobile telephones.

Accommodation

The island has over 1000 accommodation spaces, comprising of 400 hotel rooms with different standard and 650 residences including villas and suites. Four residential estates have been allocated in the Comprehensive Plan of Kish.

N.B.:

  1. According to relevant present Laws and Regulations enforced in the mainland as well as Iran’s free Zones, land can be sold and leased to Iranians, but only leased to foreigners.
  2. The above figures should be deemed as general idea on various utilisation of lands in Kish Island. For precise information on the prices and leasing fees for various types of land applications, and in various locations and the manner of land cession one should call on the very Kish Free Zone Organisation.
  3. Kish Island has various residential and industrial locations the prices of which land differ accordingly.
  4. A road so called " World Road" is allocated the banks of which allotted for various provinces of the mainland as well as the other countries enabling them to construct and set up permanent commercial exhibition centres . The land is only leased but not sold to any person.

Free Trade - Industrial Zone

Geographical Situation

The largest Island in the Persian Gulf, Qeshm is situated at the mouth of the strait of Hormoz, 22 kms from Bandar Abbas and 220 kms from the UAE. The total area of this Free Zones is 300 sq. kms.

Major Characteristics

The rich natural gas reserve of the Island, refined in Gavarzin Refinery, provides all the gas used in the area. Above that, other oil and gas reserves have been explored around the Island. The Island's deep coast enables the construction of quays for high tonnage vessels.

Accessibility

Not only Iran and the Central Asian Republics markets are in the sphere of influence of Qeshm Free Zones, but also the countries at the southern coast of the Persian Gulf, particularly the UAE.

Communications Network

The Free Zones has a high quality road transportation network. An international airport will welcome passengers and cargo aircraft to the Island. Numerous ferries, barges and speed boats enable passengers to travel to and from nearby Bandar Abbas.

A plan for the Persian Gulf bridge connecting Qeshm to the north coast of the Persian Gulf has been prepared.

Public Utilities and Services

The Free Zones is connected to the nationwide electricity network. Moreover, power stations have been installed in the Zone. The water is provided by desalination facility and a few wells. Internationally connected telecommunication is also available in the Island.

Accommodation

A 108 room hotel compatible to international standards is now under operation . The present hotel has all the appropriate facilities to welcome guests. There are also over 160 villas and suites which provide around 700 rooms.

FREE TRADE-INDUSTRIAL ZONE

Geographical Situation

Chabahar Free Zones is situated on international shipping routes in the sea of Oman and the Indian Ocean. It covers a total area of 145 sq. kms. The Zones is situated next to the town of Chabahar.

Major Characteristics

The sole port and entry point to the mainland via Oman Sea, it links the Central Asian Republics with international waters for the transit of goods. Chabahar is best known for its access to the abundant fisheries in the Oman Sea. Most of the tropical produces can be cultivated there.

Accessible Markets

The strategic position of Chabahar gives it ready access to international waters, and places it in a most convenient position among regional markets.

Communications Network

There is a dock in Chabahar Free Zones which harbours ocean-going vessels and facilitates loading and unloading of up to 2000000 tons of goods per year. An international airport, and land transportation routes which links the area to as far as the Central Asia.

Utilities and Services

Adequate reserves of water and electricity, efficient telecommunication network, warehouses and cold storage facilities are readily available.
